Trump’s National Guard Order Blocked—Padilla Detained at Press Event
*In a victory for California Governor Gavin Newsom, and a major legal blow to the Trump administration, a federal judge ruled that President Trump’s deployment of California’s National Guard was illegal. The ruling came just hours before Senator Alex Padilla was handcuffed and removed from a federal press conference in Los Angeles.
Padilla’s dramatic detention at the Homeland Security event added new heat to the ongoing legal and political fight between California officials and federal authorities over immigration and military control.
Judge Breyer: Trump’s Deployment Overstepped Authority
On June 12, U.S. District Judge Charles Breyer granted California’s request for a restraining order, declaring Trump’s move unconstitutional. He said the president violated the Tenth Amendment and lacked the authority to seize control of the state’s National Guard.
Breyer ordered control returned to Governor Newsom by noon the following day. However, the Ninth Circuit Court of Appeals quickly issued a stay, delaying the transfer and setting a June 17 hearing, CNN is reporting.
Senator Alex Padilla Forcibly Removed During DHS Briefing
Later that day, Senator Padilla was handcuffed by federal agents at a press event held by Homeland Security Secretary Kristi Noem. Padilla had entered the briefing uninvited and attempted to ask questions about immigration raids and protest crackdowns.
Video shows Padilla was about 20 feet from Noem and not behaving aggressively when he was tackled, restrained, and escorted out. He was released after showing identification. No charges were filed.
Newsom, Democrats Blast Federal Actions as Authoritarian
Governor Newsom warned that Trump’s use of the Guard is part of an “authoritarian overreach” and called Padilla’s treatment “a dark moment for democracy.” He said such actions threaten the balance of power between state and federal governments.
Senate Majority Leader Chuck Schumer and Rep. Adam Schiff demanded investigations into both the Guard deployment and the handling of Padilla’s removal.

Trump Doubles Down, Threatens Newsom with Arrest
Trump’s administration defended the deployment as necessary to protect federal personnel and property during recent protests. He accused Newsom of allowing chaos to spiral out of control in Los Angeles.
Trump went further, suggesting Newsom could be arrested for blocking immigration enforcement, inflaming the political conflict even more.
Appeals Court Steps In, Delays Guard Ruling
Despite the district court’s ruling, the Ninth Circuit issued an administrative stay. The appeals panel includes two Trump-nominated judges and one Biden appointee, raising questions about how politics may influence the outcome.
The legal showdown is now set for a full hearing on June 17, with California’s Guard remaining under federal control in the meantime.
Protests Continue as National Focus Turns to LA
Protests in Los Angeles began on June 6 in response to aggressive ICE raids. By June 9, over 50 arrests had been made amid scattered violence, including burning cars and attacks on officers.
Mayor Karen Bass said local police and state forces are fully capable of handling the unrest, adding that federal intervention is unnecessary and risky.
Padilla’s Role in Federal Clash Draws National Attention
Padilla, California’s first Latino U.S. Senator, is a longtime advocate for immigrant rights and state sovereignty. His team said he was fulfilling oversight duties when he entered the DHS event.
After the incident, he briefly met with Secretary Noem. Homeland Security claimed he engaged in “political theatre,” but many Democrats say he was targeted unfairly.
Why This Legal Showdown Matters Nationwide
This marks the first time since 1965 that a president has deployed a state’s National Guard without its governor’s approval. The case could redefine federal-state relations moving forward.
With Padilla’s incident symbolizing broader tensions, and the Ninth Circuit hearing looming, the outcome could set a precedent affecting every U.S. state.
