*President Donald Trump has announced that he is canceling every executive order he says President Joe Biden authorized through an autopen, asserting that the automated signatures account for nearly all of Biden’s directives. Trump’s decision follows his earlier call for an investigation into Biden’s alleged reliance on the device, which is used to reproduce signatures on official documents.
The White House has previously said Trump reversed a number of Biden’s actions upon returning to office, but challenges to the legitimacy of documents signed by autopen could have wider repercussions. Trump suggested the issue may affect presidential pardons and other decisions tied to Biden’s tenure. However, legal analysts have pushed back, noting that the technology has been used by American presidents since the early 19th century, according to Newsweek.
In a post on Truth Social, Trump wrote: “Any document signed by Sleepy Joe Biden with the Autopen, which was approximately 92% of them, is hereby terminated, and of no further force or effect.” He continued, adding: “I am hereby cancelling all Executive Orders, and anything else that was not directly signed by Crooked Joe Biden, because the people who operated the Autopen did so illegally.” Biden has dismissed similar accusations, stating, “Let me be clear: I made the decisions during my presidency.”
According to the American Presidency Project, Biden issued 162 executive orders; however, the number of orders that used an autopen is not publicly known. Barbara McQuade, a former U.S. attorney, told Newsweek that “auto-pen signatures are valid” and said the method of signing does not change the authority of an executive order.
Ed Whelan echoed the point, writing that Trump “is free to revoke all of Biden’s executive orders,” but not other documents such as bills approved through autopen signatures.
Some Republicans have described the situation differently. Representative James Comer wrote on X that “the Biden Autopen Presidency is one of the biggest political scandals in U.S. history.” Others, including attorney Aaron Parnas, have criticized Trump’s claims, noting that Biden cannot be charged with perjury.
