*Kroy Biermann is pushing for a major change in his custody arrangement with estranged wife Kim Zolciak, claiming she has not been consistently present in their children’s lives. The former NFL player has asked a judge to grant him sole custody of their four minor children, TMZ reports.
According to court filings, Biermann is seeking to end their current joint custody agreement, arguing that the situation no longer reflects the children’s best interests. He alleged that “the facts surrounding [Kim’s] misguided parenting of the children, lack thereof, and blatant mismanagement of basic parenting responsibilities would be practically unbelievable to anyone not familiar with the circumstances.”
Biermann also accused Zolciak of dishonesty when the temporary custody agreement was put in place. He claimed she committed “fraud and deceit” in securing the joint arrangement and has since failed to uphold her responsibilities.
In the filing, Biermann stated that Zolciak was out of the country for an extended period and did not exercise her parenting time between February 26 and March 29, aside from one overnight visit on March 9. Additional concerns raised in the documents include claims that Zolciak has not followed agreed-upon therapy plans for the children. Based on these allegations, Biermann is requesting primary custody as soon as possible.

Zolciak has strongly denied the accusations, pushing back against Biermann’s claims in a public statement. “These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. I spent five weeks away working on two TV shows to support my family and make sure my children are cared for—something I will never apologize for.”
She continued, “I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent, the truth is on my side, and it will come to light—no matter how hard anyone tries to bury it.”
The former couple, who split in 2024, have remained locked in an ongoing legal battle as they work through custody and other disputes.
