
*Kanye West’s legal team offered a controversial defense in a lawsuit alleging he sent antisemitic and abusive messages to a former employee.
In a filing submitted Wednesday, West’s attorneys argued that the messages, which include statements like “I am a Nazi” and “You ugly as f**k,” are protected speech, asserting that the rapper’s entire persona constitutes a form of art, Page Six reports The lawsuit, filed in February by a former employee identified as Jane Doe, claims the rapper bombarded her with hostile texts in June 2024, including phrases like “Shut the f**k up bitch” and “Hail Hitler.”
The plaintiff, a Hollywood publicist, alleged that West’s harassment intensified after she suggested he publicly denounce Nazism amid controversy over the Nazi-style imagery featured on the cover of his “Vultures Vol. 1” album. West’s lawyers described his messages as “works” and characterized them as part of his artistic expression.
Per their response, the texts “plainly reflect [West]’s artistic critique of censorship, identity, and beauty standards, and which were wholly consistent with his public artistry and presentation long before [the former staffer] explicitly sought employment.”
The defense draws on the concept of Gesamtkunstwerk, or “total work of art,” likening West’s persona to a continuous performance that merges art and life. The filing compares him to 19th-century composer Richard Wagner, asserting that West’s public and private actions, including private communications, are all facets of an artistic expression that challenge norms and are shielded under the First Amendment and California’s constitutional protections for free speech.

Per Page Six, in the filing, the attorneys noted: “[West] is not merely a creator; he is art. Like [19th Century German composer] Richard Wagner’s concept of Gesamtkunstwerk—a ‘total work of art’ integrating music, drama, and stagecraft—[West’s] public and private personas form a continuous, provocative performance that challenges societal taboos surrounding race, religion, gender, power, politics, and censorship. Whether on stage, in the studio, online, or in private communications, [West] is constantly engaged in artistic expression protected by the First Amendment and California’s free speech guarantees.”
The court has yet to rule on whether Ye’s messages can be legally considered protected artistic speech.
The lawsuit adds to a growing list of controversies surrounding West, who has repeatedly made inflammatory statements in recent years. The father of four has been dealing with multiple legal battles. In November, he was sued by a model who accused him of sexual assault during a 2010 music video shoot, and he faces additional lawsuits related to his now-defunct Donda Academy.
