
*A new development in the murder case of conservative commentator Charlie Kirk has cast doubt on a key piece of forensic evidence.
Tyler Robinson, 22, is charged with capital murder and faces a potential death sentence in connection with the shooting death of Kirk at Utah Valley University on September 10. Prosecutors allege Robinson drove three hours from his home to the campus with the deliberate intent to kill him. However, defense attorneys are now challenging a key piece of evidence, arguing that the bullet recovered from Kirk’s body may not have been fired from the rifle linked to Robinson, according to The Daily Mail.
DNA evidence further complicates the case. Reports from the FBI and ATF indicate multiple contributors on several items, requiring detailed analysis. The attorneys stressed that reviewing these findings involves input from forensic biologists, geneticists, system engineers, and statisticians to properly evaluate the scientific reports.
The defense has also received roughly 20,000 files from prosecutors, including video footage, audio recordings, and written documents. They noted, “The defense team has devoted, and will continue to devote, significant resources, to processing discovery, including identifying materials not yet received to inform readiness for the preliminary hearing.” Reviewing all materials, they said, will require hundreds of hours.
According to the filing, prosecutors are expected to present evidence in “discrete buckets” through law enforcement witnesses. This may include DNA and ballistic reports, social media data, crime scene testimony, statements from Robinson’s parents and roommate, and hearsay from non-testifying officers.
Robinson is scheduled to return to court on April 17, where attorneys and prosecutors will debate whether cameras should be permitted during the trial. Kirk’s widow, Erika Kirk, has made her position on media access clear. “We deserve to have cameras in there,” she said.
