*Reality star Kandi Burruss’ estranged husband, Todd Tucker, is asking for primary custody of their two children as their divorce unfolds. According to a court filing obtained by Us Weekly, Tucker submitted a response to Burruss’ divorce petition on November 26, revealing that the children are currently living with him in Georgia while Burruss, 49, travels for “out-of-state work obligations.”
Tucker, 52, emphasized that Burruss’ professional commitments “will continue to require her to be away from the children for at least the next several months,” as he petitions for primary custody. He added, “The parties have been working cooperatively in an effort to resolve all issues, and [Tucker] remains committed to continuing those discussions in good faith.”
Tucker further stated, “in the hopefully unlikely event” that an agreement cannot be reached, he would seek primary physical custody, joint legal custody of son Ace and daughter, Blaze, and final decision-making authority, while also ensuring “[Burruss] having substantial time and meaningful access to the children.”
His filing highlighted Burruss as a devoted parent: “[Tucker] wishes to make clear that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters.”

The filing also raises questions about the couple’s prenuptial agreement. Tucker claimed he was pressured into signing the prenup without legal representation. His attorneys said, “Despite that knowledge, [Burruss’] counsel presented the final agreement to [Tucker] for signature immediately before the wedding ceremony, without any notice to or consultation with [Tucker’s team], who had been significantly engaged in the negotiation process.” He is requesting division of all marital assets and possibly alimony if the prenup is deemed unenforceable.
Burruss filed for divorce on November 21, citing an “irretrievably broken” marriage and proposed joint custody of their children. She also wants the prenuptial agreement enforced and debts equitably divided.
