*Sean “Diddy” Combs remains incarcerated following a partial acquittal in a high-profile Manhattan trial, with sentencing scheduled for October 3, 2025. Convicted on two counts of transportation to engage in prostitution, Combs faces up to 20 years in prison, though prosecutors recommend a four- to five-year term.
As the New York Post reports, Robert Shapiro, O.J. Simpson’s former defense attorney, offered a sobering outlook, estimating a sentence of 2.5 to 3.5 years based on sentencing guidelines. “Whether or not he had a criminal history, I don’t know. That could raise it,” Shapiro told Fox News Digital. “But, having said that and having seen that this judge did not release him on bail, I think a message may be coming that ‘You’re going to be spending a lot more time, so no reason to let you come out and come back in.’”
The trial, which began May 5, 2025, saw Combs acquitted of graver sex trafficking and racketeering charges, averting a potential life sentence. Testimonies from Cassie Ventura and another witness, “Jane,” highlighted alleged abuse, influencing Judge Arun Subramanian’s decision to deny bail. Shapiro cited a 2016 surveillance video showing Diddy attacking Ventura, stating, “If the judge looks at that tape in his mind and is reminded about it again … I think there is a real chance that a substantial sentence will be forthcoming.”
Celebrity lawyer David Chesnoff suggested the sentencing guidelines point to a shorter sentence, but Subramanian might impose a “variance” to account for unconsidered factors.
“I got the sense from this judge that he feels that [Diddy is] deserving of punishment, otherwise he wouldn’t have kept him in,” Chesnoff told Fox News Digital. “So it’s hard to speculate. The maximum sentence is 10 and 10. That’s very unlikely. But do I think that he’ll get somewhere above what the defense wants and lower than what the government wants? I think he’ll split the baby.”
Shapiro previously praised the defense team’s strategy, particularly their decision not to have Combs testify, a move echoed by Harvard Law professor Alan Dershowitz.
“The smart decision here was not putting Combs on the witness stand,” Dershowitz said.
As Combs engages in rehabilitation programs, possibly to demonstrate remorse, his fate hangs in the balance, with an appeal expected post-sentencing.
