
*Attorneys representing Sean “Diddy” Combs have filed an appeal challenging his prison sentence and requesting his immediate release from federal custody. The legal filing argues that the court exceeded its authority when determining his punishment.
According to reports, appellate attorney Alexandra A.E. Shapiro maintains that the 50-month sentence imposed on Combs after the jury found him guilty on two counts of transportation for the purposes of prostitution involving Cassie Ventura, another former girlfriend, and male sex workers, was excessive. He was acquitted of racketeering conspiracy and sex trafficking charges. The jury rejected allegations that Combs orchestrated a criminal operation.
The appeal takes aim at U.S. District Court Judge Arun Subramanian’s sentencing approach, with Shapiro accusing the judge of acting as a “thirteenth juror” by weighing conduct the jury had dismissed. According to the filing, the court “insisted it needed to impose a ‘serious sentence’ reflecting the ‘aggravating factors that I have addressed,’ especially ‘the coercion.'”
A spokesperson for Combs explained to Rolling Stone: “We’ve filed the final appellate brief in United States v. Combs, and it raises issues that go well beyond this case. In short, the appeal argues that the district court imposed a record-setting sentence by relying on conduct the jury explicitly rejected, in direct conflict with the 2024 Sentencing Guidelines and core constitutional principles. The filing asks the appellate court to vacate the sentence and order immediate release, or alternatively to reverse the convictions or remand for lawful resentencing limited strictly to the offenses of conviction.”
Defense lawyers additionally claim First Amendment violations occurred, noting Combs filmed sexual performances during freak-offs but served as “an observer and producer” without participating in the sexual activities.
The 56-year-old currently resides at FCI Fort Dix in New Jersey, with a scheduled release date of May 8, 2028.
