Judge Rules Wrongful Death Lawsuit Against Kyle Rittenhouse Can Proceed

*Kyle Rittenhouse is facing a wrongful death lawsuit filed by the father of one of the men he shot and killed during a social justice march in Kenosha, Wisconsin in 2020. 

A federal judge in Wisconsin ruled Wednesday that a wrongful death lawsuit filed by the father of Anthony Huber can proceed against Rittenhouse, The Associated Press reports. 

Huber’s father, John Huber, filed the lawsuit in 2021. He accuses officers at the scene of the protests, over the police shooting of Jacob Blake, of fostering an environment that allowed for his son’s constitutional rights to be violated, resulting in his death. 

Rittenhouse was 17 years old when he armed himself with an AR-style semi-automatic rifle to attend the protests. There, he shot and killed Anthony and Joseph Rosenbaum and wounded a third person.

Rittenhouse was charged with homicide, attempted homicide, and reckless endangering. He was ultimately acquitted of all charges in November 2021.

Huber accuses Rittenhouse of conspiring with law enforcement to intimidate and cause harm to protestors. He is seeking unspecified damages from city officials, officers, and Rittenhouse, per The AP.

Rittenhouse and the defendants sought to have the lawsuit tossed but on Wednesday, U.S. District Judge Lynn Adelman dismissed their motions.

The judge said that Anthony Huber’s death “could plausibly be regarded as having been proximately caused by the actions of the governmental defendants.”

“While we respect the judge’s decision, we do not believe there is any evidence of a conspiracy and we are confident, just as a Kenosha jury found, Kyle’s actions that evening were not wrongful and were undertaken in self-defense,” said Rittenhouse’s attorney Shane Martin.

The Judge’s ruling in the civil rights lawsuit puts the victim’s family “one step closer to justice for their son’s needless death,” said Anand Swaminathan, one of the attorneys for Anthony Huber’s parents.

“The Kenosha officials that created a powder keg situation by their actions tried to claim that they cannot be held accountable for their unconstitutional conduct; that argument was soundly rejected today,” Swaminathan said.
