Judge Dismisses Matt Barnes’ Restraining Order Against Fiancée’s Ex

*A judge has dismissed the restraining order filed by Matt Barnes against his fiancée Anasa Sims’ ex-husband after the ex-NBA star failed to show up in court last week.

Barnes did not appear at a court hearing where he was expected to seek a permanent restraining order against Sims’ ex David Patterson Jr., Radar reports. We reported previously that Barnes and Patterson got into a heated confrontation at a Cowboys vs. 49ers football game back in January.

In a video that went viral, Barnes is seen spitting on Patterson, who reportedly lawyered up for a potential court battle with Barnes. According to court documents obtained by The Blast, Patterson is suing for battery, assault, and intentional infliction of emotional distress.

Barnes claimed Patterson approached him at the game, threatened him, and shoved him. Days later, Barnes filed for a restraining order claiming Patterson “hunted me down and aggressively confronted me.”

In the temporary restraining order, a judge ordered Patterson not to come within 100 yards of the ex-NBA star. Barnes failed to appear in court this week, thus dissolving the order, according to RadarOnline.

According to court documents obtained by The Blast, Patterson is suing for battery, assault, and intentional infliction of emotional distress. Patterson alleges that he was “wrongfully, maliciously, and violently assaulted, battered, threatened, and injured” by Barnes.

Per The Blast report, Patterson says Barnes “intentionally spit” in his face with the “intent to harm and/or offend him.”  Patterson says he “continues to suffer from injury, emotional distress, pain and suffering, embarrassment, and humiliation.”

Patterson says the insult has caused him to suffer “mental and emotional pain, distress and discomfort, all to his detriment and damage in amounts not fully ascertained but within the jurisdiction of this court and subject to proof at the time of the trial.”

The court documents include text messages between Barnes and Patterson’s fiance Melisa Andino. According to The Blast, one alleged text message from Barnes states, “Melisa are your lips good for anything other than sucking d***? Control your man he’s losing it.”
