Tennessee Man Sues ‘Deceptive’ Popeyes for ‘False Advertising’ After Chicken Sandwiches Sell Out

* Popeye’s has sold out of its coveted chicken sandwich and one Tennessee man is so pissed about it that he has filed a lawsuit against the food chain for “false advertising.”

Craig Barr notes in his civil summons that he was unable to cop a sandwich, calling Popeyes failure to meet the demand “false advertising, deceptive business practices by entity to public” and citing the “countless time wasted driving to and from Popeyes.” He added, “No chicken sandwich. Was told to come back this day-still no sandwich,” per Complex. 

We previously reported, Popeyes released a statement on Tuesday announcing it will sell out of the popular item come end of the week. But the company assured customers it’s “working tirelessly” to bring back the savory sandwich as soon as possible.

“We have seen an extraordinary demand for the new Popeyes Chicken Sandwich following our nationwide launch on August 12. It has been amazing to see our guests share their love for our brand and for the new Chicken Sandwich on social media and beyond, and we are truly humbled and grateful for their support,” Popeyes wrote in a statement. “The demand for the new Chicken Sandwich in the first few weeks following launch far exceeded our very optimistic expectations. In fact, Popeyes aggressively forecasted demand through the end of September and has already sold through that inventory.”

The statement continues: “As a result, Popeyes restaurants across the country are expected to sell out of the Chicken Sandwich by the end of this week. We, along with our suppliers, are working tirelessly to bring the new sandwich back to guests as soon as possible. In his complaint, Barr states that he answered a Craigslist ad from an alleged Popeyes worker who offered to sell him “stashed” sandwiches for $24. However, the person simply took off with Barr’s money and never came through with the goods.

Barr is seeking $5,000 and has been assigned an Oct. 28 court date.

“It’s totally deceptive. Who runs out of chicken? It’s a big fiasco. Someone has to stand up to big corporate,” Barr told the Times Free Press. “Everyone is captivated by these sandwiches. They’ve got everyone gassed up on them.”
