The group consists of five men who were wrongfully convicted in connection with the 1989 assault of Trisha Meili, an investment banker. The lawsuit suggests that Trump made false statements about them, particularly during a debate with former Vice President Kamala Harris.
A federal judge has refused to dismiss the lawsuit, which means the case will proceed. However, Dershowitz expressed significant doubts about the plaintiffs’ chances in court. He appeared on “The Record With Greta Van Susteren” to share his perspective on the matter, Daily Caller is reporting.
Legal Concerns
Dershowitz described the case as “legally tenuous” and warned of the potential political risks for the plaintiffs. “This is going to be a very hard case for the plaintiffs to win,” he explained. He pointed out that the Central Park Five were not completely innocent and had been involved in actions in the park that “certainly were not commendable.” While they did not admit guilt, the case has many layers that could complicate their claims.
“If this case actually goes to trial,” Dershowitz added, “we’re going to get depositions that show exactly what they did and where they were every minute of time.” This scrutiny could expose details that the plaintiffs would rather keep private.
Ambitions and Scrutiny
Dershowitz also highlighted that some of the plaintiffs are pursuing political careers now, which adds more complexity to the case. “These are all people now with political ambitions. They’re running for office. They’re presenting themselves as the most wonderful people on the face of the earth. They were not,” he suggested.
He noted that the more the case is examined, the more gray areas will be revealed. A critical issue will be whether the plaintiffs are considered public figures. If they are, they will have to prove that Trump falsely accused them with “reckless disregard of the truth.”

While Dershowitz admitted that the case might ultimately settle out of court, he believes that a full trial would be beneficial. “My feeling is probably, in the end, the case will settle,” he said, “but the public would be served by having this case actually litigated and seeing the real dynamics of what went on that terrible, terrible night.”
The case dates back to the brutal attack on Trisha Meili in Central Park while she was jogging. The assault was so severe that doctors feared she wouldn’t survive. Initially, prosecutors treated the case as a potential homicide, leading to the wrongful convictions of the Central Park Five.

“The plaintiffs also have another problem. He said the same thing years earlier,” Dershowitz explained. This means that they need to establish that Trump’s comments during the debate caused new damages. They are claiming that Trump’s earlier full-page ad in the New York Times defamed them before.
“Now, the New York Times versus Sullivan established the principle that you don’t have to name the person specifically in order to be guilty,” said Dershowitz. Rather, it is sufficient to describe them in recognizable ways. This aspect introduces complexity to the case, as it blurs the lines of accountability.
