*A California family has launched a legal battle against Marriott International following the tragic scalding death of 72-year-old Terril Wade Johnson Sr. in a hotel shower.
According to the Sacramento Bee, the incident occurred during a trip to celebrate his granddaughter’s graduation from San Jose State University. Johnson, a U.S. Marine Corps veteran, was staying at the Fairfield by Marriott Inn & Suites San Jose Airport when the tragedy unfolded on May 22. Family members discovered him unresponsive in the tub, where the water was so scalding they burned themselves trying to help.

“Within minutes, his family found him unresponsive, partially submerged in water so dangerously hot that they could not touch him without burning themselves,” the complaint says. “As they struggled desperately to save him, they were forced to watch in horror as his skin peeled away from his body.” First responders pronounced him dead at the scene.
The lawsuit, filed October 15 in Santa Clara County Superior Court, claims the shower water reached 134 to 136 degrees, far exceeding the legal limit of 120 degrees. A medical examiner determined severe scalding burns caused his death, affecting 33.5% of his body. Johnson was “effectively boiled alive in what should have been the safety of his hotel room,” per the complaint.
“They were horrified to observe that his skin was sloughing off due to the severity of the burns,” the family’s attorneys wrote in the filing.
The family, including Johnson’s wife Linda and son Terril Johnson II, is suing for negligence and emotional distress. They argue the hotel failed to maintain safe water temperatures despite known risks. “This was not a freak accident; it was the direct result of Defendants’ gross negligence and failure to meet even basic safety obligations.”
The family seeks damages, funeral costs, and a jury trial.
