*Meghan Markle and Prince Harry are suing unnamed photographers after images surfaced of their son Archie playing in the backyard of their Los Angeles home.
The invasion of privacy lawsuit alleges that unnamed individuals snapped recent pictures of the toddler with the caption that they were taken during a family outing in Malibu, PEOPLE reports.
The couple claim, however, that Archie has not been in public — and certainly not in Malibu — since the family’s arrival to the U.S.
The couple’s lawyer, Michael J. Kump, said in the docs, “Every individual and family member in California is guaranteed by law the right to privacy in their home. No drones, helicopters or telephoto lenses can take away that right,” Kump said in a statement. “The Duke and Duchess of Sussex are filing this lawsuit to protect their young son’s right to privacy in their home without intrusion by photographers, and to uncover and stop those who seek to profit from these illegal actions.”

The Duke and Duchess of Sussex relocated to California in March, are said to be living in Tyler Perry’s Beverly Hills mansion, where they allege the photos were taken. They also claim paparazzi have used drones to fly above the property.
“It is clear from a description of the photographs being shopped that they were taken of activities in the backyard of the residence, unbeknownst to the Plaintiffs,” the legal papers state. “The unscrupulous people shopping these photographs have not innocently mislabeled the photographs as having been taken in a public place. They have done so intentionally, because they know that unsolicited photographs of a young child in the privacy of his own home are very much unlawful.”
Harry and Meghan don’t know the identity of the photographer who unlawfully photographed their son, they are requesting the right to discover buyers and sellers of the photos, via subpoenas.
They are seeking damages, attorney’s fees and the cost of the lawsuit. They’re also requesting all photos be turned over to them.
“The Plaintiffs have done everything in their power to stay out of the limelight — except in connection with their work, which they freely admit is newsworthy. But the photos at issue are not news. They are not in the public interest. They are harassment,” attorneys state in the papers.
