
*A social media content creator with millions of followers has been ordered to pay substantial damages in a North Carolina lawsuit centered on adultery claims.
PEOPLE reports that Brenay Kennard must pay $1.75 million following a jury decision this week in Durham County Superior Court. The lawsuit was brought by Akira Montague, who accused Kennard of destroying her marriage to Timothy Montague through an extramarital relationship.
The case involved two rarely-used legal theories that North Carolina is among only a few states to still recognize: alienation of affection and criminal conversation. Akira’s original claim sought $3.5 million, alleging that Kennard deliberately undermined her marriage while openly displaying the relationship on social platforms.

Kennard has a following of over 3 million across TikTok and Instagram, and her lifestyle content frequently features Timothy. Court documents claimed that Kennard began including Timothy in her videos while he remained married, allegedly without Akira’s awareness. The suit also contended that Kennard posted images of Akira’s children with Timothy and defended the alleged affair during a live broadcast.
The jury awarded $1.5 million for alienation of affection and $250,000 for criminal conversation. Timothy testified that his feelings for Akira were never romantic and that they had split in 2021. Akira contradicted this, stating Timothy returned home regularly and they maintained physical intimacy.
Acting as her own attorney, Kennard argued during her closing remarks that she bore no responsibility for the marriage’s collapse, asserting it had been deteriorating long before her involvement.

Following the decision, Kennard criticized the outcome and claimed that the lawsuit was motivated by financial gain. She also alleged that Akira’s legal team “lied the entire time.”
“The truth will always be the truth and it’s easy to believe the lies, especially when playing the victim card,” wrote Kennard. “[Akira] may have won the battle but not the war. God will have the final say.”
Timothy similarly condemned the verdict, suggesting Akira’s legal team succeeded through emotional manipulation. “It’s easy to make someone out to be the villain when you don’t want to face the truth or take accountability,” he wrote, per PEOPLE. “The marriage was NOT full of genuine love. All parties involved know that. God will get the glory.”
Akira’s attorney countered that the case concerned holding someone responsible for their actions rather than seeking revenge.
“The evidence presented in this case overwhelmingly supported my client’s stance that Brenay Kennard not only alienated the affections of Akira’s husband but also inflicted emotional injury on his children as well,” the attorney wrote. “Akira, her family and I would like to thank all those who have supported her on this journey.”
