*Shoshone, Idaho County Prosecuting Attorney E. Paul Scott could and should have charged the John R.K. Howard and the other two white students who beat, sodomized, and terrorized a Black disabled Dietrich HS student solely because he was Black (with the complicity of the school officials, coaches, and more than a few in the community) under Idaho’s Hate Crime Law with a racially motivated hate.
“The Idaho hate crime law was adopted in 1983,”says Earl Ofari Hutchinson, President, Los Angeles Urban Policy Roundtable, “Yet, despite the heinous of the assault and the clear evidence of a racially motivated pattern of racial taunts, abuse, and the assault of the student, Scott didn’t bring a hate crime charge. Why?”
Here’s the exact statute the three alleged white assailants could have been charged under.
“Idaho’s Malicious Harassment Act (adopted in 1983) -It’s a felony to maliciously harass any person because of race, color, national origin, religion or creed. This offense is punishable by up to five years in prison and a $5,000 fine for each occurrence.”
