*Former San Francisco 49er Dana Stubblefield was charged Monday with the rape of a developmentally disabled woman following an investigation that lasted over a year, according to the Santa Clara County District Attorney’s Office.
But a lawyer for the 45-year-old former lineman says the charges are “false and fraudulent,” and that the accuser is in fact not mentally disabled, and has the ability to give consent to sex. He also says they can prove it.
Per NBCBayArea.com:
Stubblefield faces five felony counts related to the alleged assault, according to the DA’s office. The April 2015 incident occurred at Stubblefield’s home in Morgan Hill, where the woman, who is developmentally disabled, had been asked to interview for a babysitter job, prosecutors said.
The woman, who was 31 at the time, immediately went to the Morgan Hill Police Department to report she was raped, according to prosecutors.
“This was a crime of violence against a vulnerable victim,” Deputy District Attorney Tim McInerny said. “She was looking for a job and she was unconscionably assaulted.”
Per TMZ:
Stubblefield’s lawyer, Ken Rosenfeld, says he’s already provided the District Attorney’s Office “with professional lie detector results that clearly show the encounter was consensual.”
Rosenfeld says the woman had also asked Dana for a job and money after the encounter — which he claims is further proof that there was no rape.
“Dana Stubblefield is being unfairly targeted due to his celebrity and wealth by someone with full motivation to lie,” Rosenfeld said.
Stubblefield’s lawyer also says his client wasn’t even notified of the allegations until nearly a year after the incident.
“The clear motivation here is money.”
If convicted on all counts, officials say Stubblefield faces “substantial prison time.”
Stubblefield and his attorney are holding a news conference to address the charges.
