Bill Cosby: Deposition On Sex, Drugs Can Be Used At Criminal Trail

*In the never-ending spectacle that has become Bill Cosby’s life, the latest news is that damaging testimony that Cosby gave in an accuser’s lawsuit can be used at his criminal sexual assault trial, WCAU reports.

A judge ruled Monday that a 2005 deposition from a civil case brought by Andrea Constand, in which Cosby admits to extramarital affairs and giving other women drugs with their consent so they’d have sex with him, can be used by attorneys in a criminal case against him, per CNN.com.

Constand, a former employee at Cosby’s alma mater, Temple University, says the disgraced comedian drugged her and then sexually assaulted her. He now faces criminal charges in the case. His attorneys have argued that Cosby only answered deposition questions because Bruce Castor, the district attorney at the time, promised to never bring a criminal case based on Constand’s allegations.

Castor said he made that promise so Cosby would not use the Fifth Amendment to avoid answering questions in a deposition, according to an email from Castor to his successor, Risa Vetri Ferman.

The release of the deposition prompted prosecutors to reopen Constand’s criminal complaint, which was filed in 2005. When asked about the 2004 encounter at his Pennsylvania home, Cosby said he put his hand down her pants on his couch.

“I don’t hear her say anything. And I don’t feel her say anything. And so I continue and I go into the area that is somewhere between permission and rejection. I am not stopped,” he testified.

Prosecutors hope to call 13 additional women to the stand to testy that Cosby assaulted them too. The hope is to establish a pattern of similar conduct.

Cosby’s trial is scheduled to begin on June 5, 2017. He has pleaded not guilty to all charges.
