*Halle Berry scored a win in her ongoing custody case with ex-husband Olivier Martinez, with the judge siding with her on a co-parenting issue.
Earlier this summer, Halle argued in a couple filing that Olivier was trying to skip sessions in their co-parenting therapy and asked the court to order him to continue. According to new legal documents obtained by TMZ, the judge ruled in Halle’s favor but acknowledged that Olivier had already complied with her request by returning to therapy after she took legal action.
As we reported earlier, Berry is seeking sole custody of their 10-year-old son, Maceo, alleging that Olivier is not effectively co-parenting or communicating in a way that prioritizes their child. The Oscar winner is requesting custody, “or in the alternative, tie-breaking authority to make all decisions” about Maceo’s education and therapy needs, according to legal documents obtained by PEOPLE.
Berry wed Martinez in July 2013 and welcomed Maceo in October of that year. The couple called it quits in 2015, and their divorce was finalized in August 2023. Under their custody agreement, Berry and Martinez share joint legal and physical custody of their son, who has behavior and learning problems that Olivier refuses to address, TMZ reports. The actress is required to pay her ex $8,000 per month in child support, plus 4.3% of any income she earns over $2 million.
In the filing, Berry describes Martinez as uncooperative and inflexible as a co-parent. She also claims he has turned Maceo against her.
PEOPLE reports that the filing addresses her son’s behavioral concerns and “educational challenges” as Berry “fought for tutoring, an educational assessment and finding an environment that was suitable to Maceo’s needs.”
Berry claims Martinez has been “oppositional, unmoving and withheld his consent for years.”
“Because of Respondent’s opposition to any interventions whatsoever for years and because of Respondent’s prioritizing soccer activities over Maceo’s educational and psychological well-being, Maceo’s educational and behavioral challenges worsened, and he continued to fall further behind in school,” the document alleges.
According to Berry’s legal team, Martinez “ignores the professionals hired to help Maceo, and he aggressively stands in the way of implementing strategies and interventions to assist Maceo,” per the filing.
The actor has also allegedly interfered with “custodial rights, [withheld] information from Petitioner, [made] unilateral decisions on Maceo’s behalf, [involved] Maceo in the parties’ conflict, and [refused] to follow the recommendations of Maceo’s school,” the filing states.
Berry revealed in the court docs that she has spent hundreds of thousands of dollars trying to resolve the parental disputes privately but ultimately turned to a family law judge to address the conflict.
