*In an alarming incident at a Tucson, Arizona Walmart, 19-year-old Kalaya Morton, a Black cisgender lesbian, was confronted by two male sheriff’s deputies while using the women’s restroom, sparking outrage and a demand for accountability.
Morton, who identifies as masculine-presenting or a “stud,” recounted the humiliating encounter that occurred when a store employee erroneously assumed she was a transgender woman. The saga began innocuously enough: Morton had entered the restroom with her ex-girlfriend, who was kindly handing her a tampon— an act of friendship that, unfortunately, soon spiraled into something far more troubling. In an exclusive interview with The Advocate, Morton detailed her shock when the two deputies barged in, shining flashlights into the restroom stall.
“You have to get out of here. You have to come out. We need to talk to you.” Imagine trying to pee in peace, only to have the police storm in like it’s an episode of Cops: Restroom Edition.
“I’m still using the restroom. I’m sitting down, I’m peeing. What is the issue?,” Morton incredulously told the deputies as she sat there.
Now, while most people hope for a streamlined bathroom experience, Morton was treated more like a suspect than a bathroom user. The deputies apparently needed to crack the case of “Who Looks Like a Man in the Ladies’ Room,” a particularly absurd mystery, if you ask us.

Upon finally exiting the stall, Morton even lifted her shirt, thinking it would put to rest the police inquiries about her appearance. Spoiler alert: it didn’t. One deputy insisted she “looked like a man,” prompting Morton to start recording. In a now-viral TikTok video, she expressed her disbelief, saying:
“They came in here in the girls’ restroom because I’m a girl, and they didn’t think I was a girl, so they tried to come take me away.” If only the deputies spent as much energy policing real crimes as they did policing bathroom attire!
“The only men in the women’s restroom were the cops,” Morton later lamented, highlighting the ridiculousness of the situation. If you suspect a crime is occurring in the women’s restroom, wouldn’t it make sense to send female officers? Apparently not in the world of gender policing, where the old adage “two men in a bathroom can’t make a right” doesn’t seem to hold up. The Pima County Sheriff’s Department has announced an internal investigation into the incident, but their promptness raises eyebrows. Sheriff Chris Nanos stated,
“The Pima County Sheriff’s Department takes all citizen complaints seriously and investigates each and every one of them.”

How nice of him! But Morton, having had enough of this nonsense, is determined to report the incident and seek legal counsel.
“I know my rights, and I’m going to make sure this doesn’t happen to someone else,” she declared, setting the tone for what could be a transformative moment in addressing public restroom access.
Meanwhile, after the incident, Morton has understandably avoided public restrooms. She expressed her frustration about the constant battle against misgendering, which she typically brushes off but found appalling when law enforcement became involved.
“I’m afraid now. It’s already enough being Black and facing discrimination. Now I have to worry about being harassed just for needing to pee?”
If bathrooms weren’t already a pressure cooker of social judgment, Morton’s experience added a new layer of complexity entirely.

In Arizona, where there is no specific law dictating restroom usage based on gender identity, Morton’s case exemplifies the broader issues surrounding gender policing and restroom access—especially as lawmakers nationwide double down on restrictive policies regarding transgender and gender-nonconforming individuals. It’s a tough climate for anyone wanting to simply relieve themselves without fear of harassment.
Kalaya Morton’s courageous stance is not just about her own experience; it’s about ensuring that no one else suffers the embarrassment and stress of a bathroom encounter gone wrong.
She’s challenging a system that too often treats public spaces as battlegrounds for outdated notions of gender. More power to her!
As the discourse around restroom access heats up, perhaps it’s time for a simple reminder: Everyone deserves the right to use the restroom in peace—without confrontation, without judgement, and certainly without the police barging in like it’s a scene from an unrelated cop drama.
