
Haitian Migrant in Jamaica Living in Legal Limbo
*Brenor Joseph, a Haitian migrant, has spent more than two years in Jamaica waiting for official papers. Despite promises from immigration authorities, he has received no documentation or work permit.
He says this leaves him constantly afraid of being deported. Joseph does odd jobs to survive but cannot legally prove his identity, making him vulnerable to arrest at any time.
From Haiti to Jamaica: A Journey to Escape Danger
Joseph fled Haiti in 2023 after a life-threatening encounter. He boarded a boat with other desperate migrants, including children, hoping to reach Cuba.
Instead, the group drifted into Jamaican waters and was detained. Joseph described the six-month detention as harsh, calling it a prison-like experience, the Jamaica Observer is reporting.

Promises Broken, No Papers, and Ongoing Fear
Joseph said immigration officials took fingerprints and promised work permits, but nothing has happened since. Now, two years later, he lives and works without identification.
“Immigration took our fingerprints and said we would get papers so we could work. Two years later, nothing,” Joseph explained.
Haitians Claim Unequal Treatment Compared to Other Migrants
According to Joseph, Haitian migrants wait much longer for documents than other nationalities. He says Cubans arriving after them received papers, while Haitians are left behind.
“I am not going to say Jamaica have something against Haitians, but I know Jamaica not giving us paper to work,” he said.
Attorney Alleges Systemic Rights Violations by Jamaican State
Attorney Dr. Marcus Goffe, who represents Joseph and others, claims Haitian migrants are routinely denied due process. He says Jamaica violates both its constitution and international refugee law.
Goffe says lawyers are blocked from seeing clients during early detention stages. Interviews by immigration officers reportedly happen in secret, without legal support.

Secret Deportations and Lack of Fair Legal Access
Goffe says many deportations happen before lawyers are notified. Boats are arranged overnight, and migrants are returned without a fair hearing.
“By the time we’re notified, boats are already being arranged for them to be sent back. This is intentional,” Goffe argued.
Interpreters Accused of Discouraging Asylum Applications
Government interpreters are allegedly pressuring migrants not to apply for asylum. Goffe says they often tell Haitians to stay quiet or accept a return to Haiti.
“How can someone defend their rights if they don’t speak the language and the person assigned to help them is pushing them to give up?” he asked.
Colonial Laws Still Used to Strip Migrants of Rights
Goffe criticized Jamaica’s use of old colonial laws like the Aliens Act. The law allows authorities to classify migrants as “not landed,” even when they are physically present in Jamaica.
This legal loophole, he says, is used to avoid constitutional protections such as access to lawyers and fair hearings.

Limited Resources No Excuse for Ignoring Rights
Goffe acknowledges Jamaica’s economic challenges, but argues that rights are not optional. He says if Jamaica has signed international agreements, it must honor them.
“If Jamaica has signed on to protect refugees, then we must follow the law,” Goffe stated.
Some Protection from Courts, But Many Remain At Risk
In a few cases, courts have blocked deportations through emergency orders. But most Haitian migrants do not have lawyers, leaving them open to sudden removal.
“Some are applying for asylum, some are seeking other immigration options, and some are simply trying to survive,” Goffe said.
Living in Peace, But Not Without Fear
Joseph says life in rural Jamaica is peaceful compared to Haiti. He hears no gunfire and feels physically safer. But the fear of deportation never leaves.
“Today I might be here, tomorrow they might come looking for us to take everybody back,” Joseph said.
