*The mother of late rapper Takeoff has filed a wrongful death lawsuit against the owners of the venue where her son was fatally shot last year.
Titania Davenport is seeking $1 million in damages from 810 Billiards & Bowling in Houston, according to Complex.
We reported previously via CNN, Takeoff was an innocent bystander to an argument that took place outside the bowling alley in November that led to the shooting, according to police. He was unarmed and not involved in the argument. Takeoff was shot in the head and the torso, according to the coroner’s report.
According to Rolling Stone, Davenport accuses 810 Billiards & Bowling of failing to provide proper security on the day Takeoff was killed. The lawsuit claims the venue didn’t utilize “screening mechanisms, [or] after-hour controls or security measures.”
“In fact, social media posting in advance of the party made it clear that not only basic security measures needed to be followed, but advance planning and consideration should have been taken into account, which defendants were negligent in failing to do,” the suit alleges.
Davenport is seeking “compensatory, special, economic, consequential, general, punitive, and all other damages permissible under Texas law.”
Last month, a Texas grand jury charged Patrick Xavier Clark, also known as DJ Pat, in the killing of the artist.
Clark was indicted on murder charges on May 25. In a statement to TMZ, his attorney, Carl Moore said, “Today’s action by the grand jury is not unexpected.”
Moore continued, “We would ask people to remember that getting an indictment requires meeting a very, very minimal standard of proof. When we get inside a courtroom and in front of a jury, where we will be able to put on our evidence and cross-examine the state’s witnesses— where the standard of proof is guilt beyond a reasonable doubt— we expect the jury will come back with a verdict of not guilty.”
