Marlon Wayans Claims Unfair Racial Prosecution in Response to Airline Employee Dispute

*Marlon Wayans is not taking claims made against him by an airline employee lightly.

In a court filing made on Thursday, the funnyman’s attorneys responded to recent allegations made by an airline employee that stemmed from a luggage dispute at a Denver airport. In the filing, Wayans stated he was being unfairly prosecuted for disturbing the peace, alleging he is being targeted because of his Black.

According to Yahoo News via the Associated Press, police revealed that Wayans was cited with the municipal violation in June. Details of the incident were noted by the AP, which referenced the filing.

In the filing, Wayans had three bags with him as he was set to get on a flight to Kansas City. It was then that the comedian was told by a United Airlines gate agent he could not get on the flight with three bags.

Although Wayans complied with airline policy and consolidated his luggage into two bags, the gate agent apparently tried to physically block him from getting on the flight, the filing said. Wayans boarded the plane anyway. He was later asked to get off the plane before it departed.

The court filing further revealed that gate agent allowed white passengers with three bags to board the flight while Wayans rearranged his luggage. About 140 people boarded the flight, the filing stated, adding that many of the passengers had three bags and oversized bags which filed United’s policy.

Included with the fling were still photos of surveillance video of white passengers with yellow arrows pointing to each of their bags. In their filing, Wayans lawyers accused the gate agent of racially discriminating against their client. In continuing to pursue charges against the “White Chicks” star, lawyers stated that Denver prosecutors are perpetuating that discrimination and denying Wayans’ right to equal protection under the law.

“The City of Denver’s position is an affront to constitutional and social equity principles,” Wayans’ lawyers said.

Responding to questions about what happened to Wayans, United issued a statement in June, saying an unnamed customer “pushed past” an employee at the jet bridge and attempted to board the plane. Statements recorded on police body camera and cited in the filing mention the gate agent telling officers that Wayans “shoved” “pushed” or “elbowed” him as the comedian boarded the plane. Wayans’ lawyers responded to the airline’s statement, labeling it a lie and saying “Scary Movie” franchise fixture may have brushed shoulders with the agent as he boarded.

According to the filing, the gate agent asked that charges be pursued, despite investigating officers being doubtful about any crime that had been committed.
