DJ Khaled to Hit Billboard Chart with Lawsuit for Robbing Him of the #1 Spot

*DJ Khaled is reportedly set to hit the Billboard Chart with a lawsuit alleging the media company unfairly disqualified him from more than 100,000 sales of his latest album “Father of Asahd,” robbing him of the No. 1 spot, Page Six reports.

Khaled accuses Billboard of omitting albums sold as part of a bundle deal with the energy drink Awake Energy Shot, which would have added 100,000 units to his final total. The music producer claims Billboard initially agreed to include albums from the bundle, but later reversed its decision, citing “anomalies” in the data. Billboard seemed to add fuel to Khaled’s fury when they included Tyler’s own bundle deal figures in his total album sales.

On May 30, Billboard announced Tyler debuted at No. 1 with 165,000 albums sold, with Khaled at No. 2 at 137,000.

Bundle deals, which offer album downloads alongside merchandise, are a standard but controversial industry practice to boost sales.

We’re told Billboard had agreed it would count downloads from Khaled’s energy drink package, which sources in the artist’s camp say amounted to more than 100,000. Billboard later backtracked, disqualifying Khaled’s entire sales from the promotion. Page Six has exclusively learned that lawyers for Khaled have fired off a letter to Silvio Pietroluongo, SVP of charts and data development at Billboard.

A DJ Khaled source said, “When Khaled’s team tried to appeal, Billboard refused to budge.”

Khaled’s management firm, Roc Nation, blames Billboard for the confusion over the sales figures. “We dispute their decision on behalf of DJ Khaled and, frankly, every artist who is forced to navigate bundling an album download with an inexpensive item that still effectively represents their brand. It’s confusing and demeaning to the art,” Desiree Perez, Roc Nation’s chief operating officer, said in a statement to the Times.

“We’re obviously not fans of bundling, nor should anyone who cares about artists making music,” Perez added. “But our hands are being forced by Billboard’s desperate, last-ditch effort to keep streaming from eliminating what’s left of music downloads.”

Khaled recently had a tense meeting with Sylvia Rhone, chairman and CEO of his label Epic, over the matter. The source explained, “Khaled was frustrated his label didn’t fight harder for his bundle sales to be included.”
