*Phaedra Parks said last month that her divorce from Apollo Nida was finalized, but TMZ reports that Apollo filed his own divorce petition on Thursday, December 1.

So…apparently, it’s not finalized.

Nida, currently serving eight years behind bars on fraud charges, also requested joint legal custody of their two sons, Ayden, 6, and Dylan, 3, and an equitable split of their assets, according to TMZ, citing court documents.

He lists the date of separation as June 2014, and says that their bond as husband and wife is “irretrievably broken.”

Parks first filed for divorce in October 2014 after five years of marriage, but the process was delayed due to Nida’s trial and subsequent imprisonment.

As previously reported, TMZ’s Raquel Harper asked the “Real Housewives of Atlanta” star directly if their divorce had been final. Phaedra responded, “It is.”

It appears that Nida now wants it to be over as well, due to his recent engagement. Us Weekly reports that his fiance “does appear on the show later in the season at one of the cast events.”

The “Real Housewives of Atlanta” airs on Bravo Sundays at 8 p.m. ET.
