Comedian Bill Cosby leaves the Montgomery County Courthouse with his criminal defense lawyer Brian McMonagle(L) after a pretrial conference related to aggravated indecent assault charges on September 6, 2016, in Norristown, Pennsylvania.

*Bill Cosby’s legal team has come up with a new argument regarding his upcoming sexual-assault trial.

According to NBC News, his lawyers are now claiming that the actor is legally blind and therefore cannot recognize his accusers in court.

“No 79-year-old blind man could possibly defend himself against a claim that he sexually assaulted someone he supposedly met once, half a century ago,” Cosby’s attorneys said in a new court filing.

The legal team also noted that Cosby registered with a state commission for the blind, and that at an upcoming pre-trial hearing, he will provide a doctor’s note attesting to his legal blindness.

Prosecutors on the case, however, contend that Cosby’s impaired eyesight does not prevent him from assisting in his defense.

Despite multiple attempts to have the charges thrown out, Cosby is currently awaiting trial on charges that he drugged and sexually assaulted Andrea Constand in 2004.
