Cosby: Chloe Goins Drops Lawsuit; Ex-D.A. Thought He Was Guilty But Lacked Proof, More

*Bill Cosby accuser Chloe Goins has suddenly and without explanation dismissed her lawsuit against the comedian.

Goins’ lawsuit seeking damages in excess of $75,000 claimed he sexually assaulted her in 2008 at the Playboy Mansion. According to the filing, Goins dismissed the case without prejudice, meaning it’s possible she can bring suit against Cosby again. It’s unclear if the two parties reached a settlement.

Prosecutors in Los Angeles decided last month not to file criminal charges against Cosby over her claims, noting that some details could not be corroborated. Cosby’s previous lawyer denied that he was in Los Angeles at the time Goins said she was abused.

This was one of several headlines to come out of Cosby’s hearing Tuesday at a courthouse in Norristown, Pennsylvania.

His legal team asked a judge to dismiss criminal sexual assault charges filed against him in December, stemming from a 2004 allegation by former Temple University employee Andrea Constand. It’s the first criminal case Cosby is facing in response to similar complaints from dozens of other women.

According to USA Today, the defense’s key witness is former District Attorney Bruce Castor, who did not pursue criminal charges against Cosby when the crime was first reported. A new prosecutor arrested Cosby on Dec. 30, just before the statute of limitations expired.

While taking the stand Tuesday, Castor said he believes the comedian inappropriately touched Constand, however, there was “insufficient credible and admissible evidence” to show Cosby had committed a crime beyond a reasonable doubt, citing a “credibility issue” with the plaintiff.

Castor says he believes his decision not to prosecute is binding on his successors and was supposed to prevent any future prosecution.

The defense says Cosby had a deal that he wouldn’t be charged, which is why he testified in his accuser’s 2005 lawsuit. “Cosby would’ve had to have been nuts” to say what he did in a 2005 deposition unless he knew he was immune from prosecution, Castor testified.

Also Tuesday morning, Cosby was ordered to undergo another deposition in the Judy Huth case.

Huth sued Cosby in late 2014, claiming he forced her to perform a sex act on him at the Playboy Mansion around 1974 when she was 15 and underage. Cosby was deposed in the case in October. Huth’s lawyers sought another deposition to get Cosby to answer certain questions.

Los Angeles County Superior Court Judge Craig D. Karlan ruled Tuesday that Cosby must appear for another half-day deposition, even if he objects to questions from lawyers for the woman.

Details about the questions or Cosby’s answers during the October session remain under seal.
