*While DMX is settling in for the next six months at the Erie County Holding Center in New York, for failure to pay child support, his ex-wife is struggling to save her house from being taken by the bank.

theJasmineBRAND.com reports that a New York judge ordered Tashera Simmons to vacate her home – do not pass go, and do not collect $200. Instead, proceed back to court to appeal the decision to allow the bank to foreclosure. DMX and Tashera were sued back in 2013 by the bank – claiming the couple didn’t make a single payment on the home since 2008. The lawsuit accused them of owing over $258,927 in back payments.

Tashera responded to the bank’s lawsuit to foreclose with a countersuit, alleging that the bank took advantage of the fact that she could not afford to have a lawyer present during settlement conferences. Simmons believes the bank withheld pertinent information that would have allowed her to save her home, including the option to modify the loan.

Tashera also accused one of DMX’s creditors, a company named Amusing Diversions, of disrupting all attempts to settle because they wanted the home to be sold at foreclosure so they could collect on the debt the rapper owed them. According to her affidavit, DMX  failed to defend himself in a legal battle with the creditor and they won a small judgement which he never paid.

On June 18, a New York judge ordered that the bank can move forward with the foreclosure. However, Tashera returned to court on July 17 and filed an appeal with the hopes that the appellate court will review her case and agree that the original judge made an error in his ruling and she can save her home from being sold off at a foreclosure auction.
