TRACY MORGAN GETS ANOTHER DUI CHARGE: ’30 Rock’ star stopped in Manhattan after cops spot him weaving.(November 29, 2006)
*Tracy Morgan is in trouble again. The star of NBC’s “30 Rock,” who is already on probation for a DWI in Hollywood, was arrested early Tuesday for drunken driving in Manhattan, reports the Associated Press. Morgan, 38, was pulled over by NYPD at 4:38 a.m. after they spotted him driving his Cadillac Escalade erratically on the Henry Hudson Parkway near West 158th Street. According to the police report, the TV star "was unable to maintain a position in a lane of traffic." Police said the actor smelled of alcohol. A rep for the Manhattan District Attorney's office said Morgan told police he was drinking beer at a club before he was stopped by authorities. Morgan was taken into custody at the 33rd Precinct and later failed a breathalyzer test. Police charged him with Driving While Intoxicated and Operating a Motor Vehicle While Impaired. The actor was arraigned and released Tuesday by Manhattan Criminal Court Judge Matthew F. Cooper without being required to post bail. He was ordered to turn over his driver’s license and return to court on Jan. 4 “for a possible disposition.” Morgan's lawyer, Sheryl Reich, turned down the prosecutor’s plea offer of a $1,000 fine, five days of community service and a DWI program. The former "Saturday Night Live" regular is currently on probation in Los Angeles for a Dec. 2005 DUI conviction. Police had pulled him over for speeding, but booked him on impaired driving charges after his blood-alcohol level was found to be 0.13 percent – which is over the legal limit of 0.08. He pleaded no contest to a misdemeanor charge and was sentenced to 36 months' probation, fined $390 and ordered to attend an alcohol education program. Should this latest arrest constitute a violation of his probation, he could face jail time in both New York and L.A.
